FREE IMAGING AND CATALOGUING OFFER - TERMS AND CONDITIONS
1. We are pleased to invite you to participate in the Free Cataloguing & Imaging Offer ("Offer"). Under this Offer, you can avail one free cataloguing and photo-shoot service for minimum of 20 and maximum of 50 products ("Service") from our designated service provider, ("Service Provider") to improve the quality of your listings on Amazon.in.
2. These Offer terms and conditions ("Terms and Conditions") are in addition to the Amazon Seller Business Solutions Agreement ("BSA") between you and Amazon. Only with respect to this Offer, in the event of any conflict in the provisions of the BSA and these Terms and Conditions, these Terms and Conditions shall prevail. All capitalized terms not defined in these Terms have the respective meanings set forth in the BSA.
3. This Offer will be available for a limited period from August 21, 2017 to October 31, 2017, both days inclusive ("Offer Period"). Upon expiry of the Offer Period, the Service will be offered to you by the Service Provider at their prevailing rate/fee.
4. In order to avail the Service, you will need to indicate your interest latest by October 15, 2017 ("Interest Period"). Once you submit your request within the Interest Period, the Service Provider's representative will contact you to understand your requirement and provide you an appointment slot as per the availability of the Service Provider's studios. If you propose to receive the Service, you will be required to provide basis product data/information in simplified excel format to the Service Provider on or before the date of the photo shoot and also bring/send your products to the Service Provider's studio on the date of such photo shoot at your own expense.
5. Please note that pick up and drop of your products is your sole responsibility. Neither the Service Provider nor Amazon will be responsible for any loss/damage or costs associated with such products. Costs connected with models or stylists need to be borne by you.
6. This Offer will only be available in the following cities: Agra, Ahmedabad, , Bangalore, Chandigarh, Chennai, Coimbatore, Delhi, Hyderabad, Indore, Jaipur, Jodhpur, Kanpur, Kochi, Kolkata, Lucknow, Ludhiana, Meerut, Mumbai, Nagpur, Panipat, Pune, Rajkot, Surat, Udaipur, Vijayawada, Vizag. If you are based in other locations, you may still avail the Service by visiting the Service Provider's studio location or carrying your products to any of the cities where the Service Provider studios are located at your own expense.
7. You will be eligible to participate under this Offer and avail the Service only if you fulfill the following conditions: -
a) Complete the onboarding documentation to Sell on Amazon.in (existing sellers are not eligible to participate in this Offer);
b) Indicate your interest to avail the Service within the Interest Period by filling up this form;
c) Fix a photo shoot appointment with the Service Provider within the Offer Period; and
d) Ensure that the photo shoot appointment is not cancelled;
8. Amazon reserves the right to determine, in its sole and absolute discretion, whether or not you have successfully met the criteria or the conditions to participate under this Offer.
9. Amazon reserves the right to terminate your participation under this Offer, at any point of time, in its sole discretion, with or without cause, including if any criteria outlined herein are not met.
10. You acknowledge and agree that Amazon reserves the right to cancel, modify, change, suspend or withdraw any of the Terms and Conditions as it may deem fit, in part or in their entirety, with or without cause, without giving any prior notice without incurring any liability whatsoever.
11. To the extent permissible under any applicable law, Amazon waives and disclaims all responsibility and liability for any damages or losses arising out of any statute, contract or otherwise from or in connection with the Offer or any Offer related activities). Amazon shall neither be liable nor responsible for any actions or inactions of the Service Provider. Amazon hereby disclaims any and all liability and assumes no responsibility whatsoever for consequences resulting from your use of the Service Provider's Service.
12. These Terms and Conditions are governed by the laws of India and the courts at Bangalore shall have exclusive jurisdiction over any disputes and/ or other matters in relation to these Terms and Conditions.
